After making the payment Gwynn said he received an email on Saturday saying the product could not be shipped immediately. On Sunday he received another email saying a refund had been made because The Warehouse could not fulfil the order due to "unforseen circumstances". The Warehouse told him the refund would take five days to process. "They sell stuff online at a cheaper rate than the shop and then all of a sudden they mysteriously can't provide it," Gwynn said. The architect graduate made a complaint on the company's Facebook page saying it was not fair trading. He included a link to the Commerce Commission's definition of bait advertising which prohibits false or misleading representations about the availability of goods under the Fair Trading Act. Retailers with an online presence must keep their website up to date so that stock or special offers that are no longer available are not promoted.

Commerce Commission spokesman Christian Bonnevie​ would not comment on The Warehouse situation specifically but said it was not uncommon for the commission to receive complaints about potential bait advertising. Much of this could be attributed to the growth in online shopping, he said. Morton said there had been an error in its "red alert" process and the wrong quantity of available stock was listed on its website. The company contacted Gwynn on Monday and were working to find him a new sofa for the same price he originally paid. Gwynn said he would accept the couch offer but was unlikely to shop online with The Warehouse again. This was the second time he had bought something online from The Warehouse only to be told it was unavailable. "They need to sort their systems out and check them a bit more thoroughly."
